Welcome to Wholesaler Connect. These Terms and Conditions (“Terms”) govern your use of the Wholesaler Connect website, platform, and related services (collectively, the “Platform”). By creating an account, purchasing a subscription, or otherwise using the Platform, you agree to these Terms. Please read them carefully.
1.1. You must be at least 18 years old and legally able to enter into contracts to use the Platform.
1.2. By registering, you represent and warrant that all information you provide is accurate, complete, and up to date. False, incomplete, or misleading information may result in suspension or termination of your account.
2.1. You are responsible for maintaining the confidentiality of your login credentials and all activity under your account.
2.2. You agree to promptly update your information if it changes and to notify Wholesaler Connect of any unauthorized account use.
2.3. Accounts are personal to you and may not be shared or transferred without prior written approval.
3.1. Access to the Platform is offered through subscription-based membership tiers. The features and pricing for each tier are described on the Platform.
3.2. By subscribing, you authorize Wholesaler Connect (and its third-party payment processor) to charge your selected payment method on a recurring basis until canceled.
3.3. Subscription fees are non-refundable, except as required by law.
3.4. You may cancel your subscription at any time, but cancellation does not entitle you to a refund for the remaining term.
4.1. Wholesaler Connect verifies buyers and title companies to support the integrity of the Platform.
4.2. You agree to provide accurate information for verification purposes. Failure to cooperate with verification may limit or terminate your access to certain features.
5.1. Strict Prohibition: You may not use the Platform to identify or connect with any party (including wholesalers, buyers, or title companies) and then conduct wholesale transactions, introductions, or closings outside of Wholesaler Connect.
5.2. Violations: Any attempt to bypass the Platform may result in:
Immediate termination of your account;
Forfeiture of all fees paid; and
Legal action, including but not limited to claims for damages.
6.1. You agree not to:
Use the Platform for unlawful purposes or in violation of any applicable laws;
Post false, misleading, or fraudulent information;
Infringe upon the intellectual property or rights of others;
Interfere with or disrupt the operation of the Platform.
7.1. All content, features, and functionality of the Platform (including text, graphics, software, and trademarks) are the property of Wholesaler Connect or its licensors and are protected by law.
7.2. You are granted a limited, non-exclusive, non-transferable license to use the Platform solely for your personal or business use in accordance with these Terms.
8.1. Wholesaler Connect may suspend or terminate your account at any time, with or without notice, if you violate these Terms.
8.2. Termination may include revoking access to your account, deleting data associated with your account, and forfeiting subscription fees.
9.1. Wholesaler Connect is not a party to any real estate transactions facilitated through the Platform. We do not provide legal, tax, or financial advice. Users are solely responsible for their business decisions and compliance with applicable laws.
9.2. The Platform is provided “as is” without warranties of any kind.
9.3. To the fullest extent permitted by law, Wholesaler Connect shall not be liable for any indirect, incidental, or consequential damages arising out of your use of the Platform.
These Terms shall be governed by and construed in accordance with the laws of the State of Kansas, without regard to its conflict of law principles.
11.1. Any dispute arising under these Terms shall first be addressed through good faith negotiations.
11.2. If unresolved, disputes shall be submitted to binding arbitration in Kansas, in accordance with the rules of the American Arbitration Association.
11.3. Each party shall bear its own costs of arbitration, except as otherwise required by law.
